Thailo — Terms of Service
Effective date: [DATE]
1. Acceptance of terms
By downloading, installing, or using Thailo (the "App"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App. These Terms apply alongside Apple's standard End User License Agreement (EULA) and our Privacy Policy.
2. What Thailo is
Thailo is a Thai-language learning app for iOS: vocabulary and phrasebook content, spaced-repetition review, an alphabet/reading track, and an AI-powered conversation-practice feature. It is an educational and travel-preparation tool, not a certified language-proficiency program, translation service, or substitute for professional interpretation in situations where mistranslation carries real consequences (legal, medical, immigration, etc.).
3. Subscriptions, trial, and payment
This is the legally required plain-language summary of the subscription mechanics — matches the current pricing in monetization.md:
- Free trial: new subscribers get a 7-day free trial. A payment method is required to start it (Apple's standard intro-offer mechanism).
- Auto-renewal: unless cancelled at least 24 hours before the end of the trial or current billing period, your subscription automatically renews and your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
- Plans and pricing (current — see
monetization.mdfor the source of truth): - Monthly: $9.99/month
- Annual: $49.99/year ($4.17/mo equivalent)
- Lifetime: $99.99 one-time purchase, no renewal
- Managing/cancelling: manage or cancel your subscription anytime in iOS Settings → [your name] → Subscriptions. Cancelling stops future renewals; you keep access through the end of the period you already paid for.
- Refunds: all purchases are billed through Apple and subject to Apple's refund policies. We cannot directly process refunds — request one via reportaproblem.apple.com or your App Store purchase history.
- Price changes: if prices change, we'll provide notice as required by law/App Store policy before any change affects an active subscription.
What's included
- Free (no subscription): onboarding + one taste lesson.
- Trial/subscription: all destinations, the full vocabulary and phrasebook, the alphabet/tone track, Practice (subject to fair-use limits — see §5), and Live Challenges.
4. Eligibility and accounts
Thailo does not currently require creating a separate account — your access is tied to your Apple ID purchase/subscription via StoreKit. You must be able to form a binding contract to subscribe (in most jurisdictions, 18+, or the age of majority where you live; if you're a minor, a parent/guardian must agree to these Terms and manage any purchase).
5. Practice and Live Challenges
- Practice grades your attempts at saying phrases in Thai; when your attempt isn't recognized, grading is powered by Anthropic's Claude API. Feedback is AI-generated for these novel attempts — while we design prompts for accuracy and level-appropriateness, AI output can be wrong, and you should not treat it as a definitive or professional source for Thai grammar, translation, or cultural guidance in high-stakes situations.
- Practice has a soft daily limit on AI-graded attempts (shown in-app) to prevent abuse of the grading service — this is not intended to restrict normal use, and is not a bug (see
spec-onboarding-and-ai.md). - Don't use Practice to submit content that's illegal, abusive, or that attempts to extract the underlying grading prompt/model behavior for purposes unrelated to language learning. We may suspend access to this specific feature (not necessarily your whole subscription) for abuse.
- Live Challenges suggest real-world activities (e.g., ordering food using Thai) for you to try outside the app, and are self-reported — we do not verify completion. You're solely responsible for your own safety and judgment in any real-world situation a Live Challenge suggests; Thailo does not supervise, endorse, or take responsibility for the outcome of any real-world interaction, and a Live Challenge is a suggestion, not an instruction to be followed regardless of circumstances.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or extract the App's bundled content/data for redistribution
- Use the App to build a competing product from its content
- Attempt to bypass the paywall, subscription checks, or usage metering
- Use the App in any way that violates applicable law
7. Intellectual property
The App, its content (vocabulary, phrasebook, illustrations, the Chang character, branding), and underlying software are owned by [Developer/Company Legal Name] or its licensors and protected by copyright and other IP law. Your subscription grants you a personal, non-transferable, non-exclusive license to use the App for personal language learning — not a license to copy, redistribute, or commercially exploit its content.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We don't guarantee the App will be error-free, uninterrupted, or that language content (including AI-generated content) is free of mistakes. Language and cultural norms evolve — content reflects our best effort at accuracy at time of writing, not a live-updated authoritative source.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [Developer/Company Legal Name] IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING DAMAGES ARISING FROM RELIANCE ON APP CONTENT (INCLUDING AI-GENERATED CONTENT) IN REAL-WORLD SITUATIONS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. [This is boilerplate — have counsel confirm what's enforceable in your target jurisdictions; some consumer-protection regimes, e.g. the EU, limit how far liability can be disclaimed.]
10. Termination
You can stop using the App and cancel your subscription anytime (§3). We may suspend or terminate access if you violate these Terms, particularly the acceptable-use provisions in §6 or the AI-feature provisions in §5.
11. Changes to these Terms
We may update these Terms as the App evolves. Material changes will be reflected in the effective date above and, where required, surfaced in-app before they take effect.
12. Governing law
[Specify: e.g. "These Terms are governed by the laws of [Country/State], without regard to conflict-of-law principles."] — fill in based on where the developer/company is legally established; get counsel input given your users will likely be international.
13. Contact
Questions about these Terms: [support email address]
Open items before publishing (see roadmap.md item 16)
- Fill in legal entity name, governing-law jurisdiction, effective date, support email.
- Confirm §9's liability-limitation language is enforceable in your actual jurisdiction and primary user markets (esp. EU consumer law) — get counsel review.
- If account creation (email/social login) is added later, add an accounts section (registration accuracy, account security responsibilities, etc.) — not needed today since access is purely StoreKit-based.
- Keep pricing in §3 in sync with
monetization.mdif pricing ever changes — don't let these two docs drift.
